McMenus & Tracy Spurlock ORDINANCE NO. 10596 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED IN THE 5500 BLOCK OF CLEAR CREEK ROAD BEING ON THE SOUTHEAST LINE OF CLEAR CREEK ROAD SOUTHWEST OF HIXSON PIKE, FROM R-2 RESIDENTIAL ZONE TO C-2 CONVENIENCE COMMERCIAL ZONE, SUBJECT TO CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located in the 5500 block of Clear Creek Road being on the southeast line of Clear Creek Road southwest of Hixson Pike. Part of three unplatted tracts, being part of the properties described in deed book 4120, page 231, ROHC, deed book 4238, page 454, ROHC, and as Tract 1 in deed book 4082, page 314, ROHC; being all of said properties which lies above the North Chickamauga Creek floodway zone as shown on the current zoning map, with the exception of that tract of land conveyed to Curtis J. and Carlain Hicks dated January 1, 1972, and recorded in deed book 2006, page 417, ROHC. Tax Map No. 100K-C-2 (part), 4 (part), and 5 (part). from R-2 Residential Zone to C-2 Convenience Commercial Zone. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. Use as a golf pro shop and driving range only. 2. No access to Clear Creek Road, except one entrance may be permitted within 150 feet of the intersection of Hixson Pike and Clear Creek Road. 3. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, as provided by law.
